§ 21.24.080. FAR amenity incentive system.

  • A.

    A structure may exceed the basic floor area ratio of Table 21T-07 only if it complies with the requirements of Section 21.24.080. In no case may the structure exceed the maximum floor area ratio and each unit of measurement (square feet, linear feet, etc.) may only be used to gain one floor area bonus, except where specifically provided otherwise;

    B.

    Participation in the FAR amenity incentive system must comply with the requirements of Table 21T-09;

    C.

    An amenity which complies with Section 21.24.080B and the site plan review process (Chapter 21.84) shall be approved, only if:

    1.

    The design criteria established for the amenity have been met, and

    2.

    The department finds that a public benefit will be derived from the development of the proposed amenity in the proposed location;

    D.

    Bonus floor area earned through the amenity incentive system for a specific parcel of land may be transferred to an abutting parcel of land in the same ownership within the same CBD land use district. Each transfer must be recorded with the Thurston County assessor and auditor, and with the county clerk;

    E.

    Amenities similar or related to those listed in Table 21T-09 may be permitted upon finding of the department that a particular unlisted amenity is consistent with this chapter and compatible with the policies of the Lacey Joint Plan. All amenities determined to be permissible under the terms and conditions of this subsection shall comply with the provisions of Section 21.24.080 to the extent practical. The value assigned to such an amenity shall be identical to the next similar or related amenity within the same CBD land use district;

    F.

    In no instance shall the calculation of FAR amenities, either granted mandatorily or voluntarily, or through FAR transfer provisions, when added to the basic FAR value exceed the maximum FAR identified in Table 21T-07 by CBD land use district;

    G.

    FAR amenity standards (see Table 21T-09).
